Ewing trustees discuss building permit fines

Should individuals who begin a building project before applying for a permit in Ewing village limits be fined?

The question was up for discussion during Ewing village board's Nov. 11 meeting.

Village Clerk Sharon Swails said she asked Clearwater village officials how they handle the process and reported Clearwater Village Clerk Angie Hupp said a $100 fine is assessed.

According to Swails, a cement slab has been poured for one project and another resident has a project that is near completion.

One of those individuals picked up a building permit application on Nov. 11. Once submitted, it will need a recommendation from the village's zoning committee and then advances to the village board for approval.

Trustee Dustin Wright asked if there would be exceptions to the rule.

"Let's say I've got 30 days to pour concrete and wintertime's coming. You know how construction works. If you're going to put your foot down, you're not going to let anybody start anything until a permit's approved," Wright said.

Trustee Katie Cunningham asked how long the approval process takes.

"It could take up to six weeks," Wright said. "If we're setting a precedent and setting a fine, it means every single person who starts a project before approval gets a fine of $100, no exceptions."

He suggested the zoning committee set an example and tell individuals who begin construction before the permit process is finalized that the structure needs to be torn down. Wright also contemplated if conditions could be established, especially when it comes to concrete, dirt work or plumbing.

Chairman James Ramold said a $100 fine is minimal.

"If you are up against a deadline, you could get started and pay the $100 fine. It's not like it's going to break you," Ramold said.

Trustee Katie Cunningham suggested talking with the village's attorney for clarification and suggestions.

The matter was tabled.
