The Board of Trustees of the Village of Clearwater met for a regular meeting Monday, Nov. 11, at 7 p.m., in the fire hall meeting room. Meeting opened at 7 p.m. Notice of Meeting was given in advance by publication in Summerland Advocate-Messenger, was posted at US Post Office in Clearwater, Clearwater Market and Cornerstone Bank-Clearwater and was given to board members prior to meeting. Public was informed of location of Open Meeting Act poster.
Present: Kelly Kerkman, Marsha Hart, Cody Kester, Brian King, Jeff Schlecht. Others present: Angie Hupp, Kyle Petersen, Troy Behnke, LuAnn Schindler, Carla Jacob, Dwaine and Deb Trease and Jay Snider.
Approved minutes of Oct. 14 regular meeting as presented.
Approved treasurer’s report as presented.
Opened hearing at 7:01 p.m. to discuss planning commission recommendations regarding annexation of parcel nos. 000660200, 000660500 and 000660501 and conditional use application for 205 Montana St.
Planning Commission recommended annexing parcel nos. 000660500 and 000660501 and tabling annexation of parcel no. 000660200 until more clarification can be received. Dwaine Trease opposed annexation of parcel 000660200, which he owns. Trease asked what advantage to village. Kerkman stated to square off the three parcels in that section that Trease uses as one, since two are already in village limits and just want to make things clearer for future use. Trease said if annexed, he wants water and sewer brought to property even though he doesn’t currently need sewer. He’d like water for planting grass. Trease stated village needs written plan to provide water and sewer to all annexed properties. Kerkman asked Jay Snider if he had an opinion on annexation. Snider said no, but the other two parcels were supposed to be annexed about 14 years ago so someone dropped the ball getting it finished.
Planning Commission recommended against conditional use permit. Carla Jacob told board why applied for conditional use permit to use camper as living quarters on their 205 Montana St. property. Jacob stated they were unaware of any regulations against it and were trying to help grandson get on his feet. Rent isn’t cheap and lack of housing available in community. Several options were discussed.
Approved closing hearing at 7:40 p.m.
Voted against allowing conditional use permit of camper for living quarters at 205 Montana St. Jacob to update board on finding housing at next month’s meeting. As long as camper is unhooked from water and sewer, it can stay in storage on property.
Approved amending Ordinance 2024-8 annexing parcel nos. 000660500 and 000660501 and striking all mention of parcel no. 000660200. First reading of amended Ordinance 2024-8 commenced.
Discussion held regarding proposed interlocal agreement with Village of Ewing to cover water operator services if either town loses operator. Board suggested $100 per month including mileage and taking regular monthly water sample with an additional $50 per weekly for readings and additional samples. Suggestions will be presented to Ewing at December meeting.
Approved Resolution 2024-8 certifying John Zwingman as Village street superintendent for 2024 calendar year.
Opened three bids for old ambulance bay HVAC system. DW’s Heating and Air bid $9,000-12,000 depending on scope and location of equipment. Electrical not included. Northeast Neb. Heating and Cooling bid $9,239.13 for materials and labor with electrical not included. Bryant Home Comfort, LLC bid $11,255 for materials and labor with electrical included.

Opened one bid for library front wall replacement and overhang repair. Ruterbories Construction bid $17,000 including materials, labor and disposal.

Economic development report presented.
Opened Citizens Advisory Review Committee hearing at 8:20 p.m. Report read by Hupp. No public discussion heard.
Approved closing hearing at 8:22 p.m.
Maintenance report presented. Discussion held regarding EPA requirements to replace all lead and galvanized lines in Village limits within 10 years. Village responsible for lines on public property but residents obligated to replace lines on personal property. No information yet on grant opportunities to assist with requirements. Partial sewer line replaced at 507 Iowa St. where NNTC fiber optic line broke bottom of pipe years ago.
Library report presented. Christmas store will be set up at Old-fashioned Christmas then at library again this year. Stay-at-home mom group successfully begun at library.
Park report. Bathroom windows replaced with solid concrete.
Approved Carhart Lumber claim of $3,060.35 for lagoon shed to be paid by USDA wastewater grant funds.
Approved Quality Iron and Metal claim of $789.70 for lagoon shed to be paid by USDA wastewater grant funds.
Clerk report presented.
No sheriff’s report presented.
Unfinished business. Discussion of proposed subdivision held during hearing. No updates from engineer on subdivision, River Rd. and Nebraska St. paving with county or sidewalk extension along Main St. and Hwy .275.
New business presented. Confirmed Dec. 9 as next regular meeting date.
Public comment heard. Jay Snider asked about ordinances to put sidewalks back in if they’re ripped out. LuAnn Schindler asked if Clearwater has lodging tax assessed against AirBnbs and guest houses. Kerkman asked about tree trimming. Troy Behnke said he’s seen quite a few people making trips to the tree dump.
Attorney report presented. Hupp told board that 205 Colorado St. has electricity to trailer house now so Kyle Petersen stated a letter should be sent to them requesting water and sewer lines be repaired if necessary so required hook-ups can be made.
Approved Schlecht Trucking claim of $498.98. Schlecht abstained.
Approved remaining claims and payroll. Claims: $49,795.96; payroll: $8,724.30.
Approved adjourning meeting at 9 p.m.
