Shane L. Krebs faced the Honorable Donna Taylor in the Antelope County courtroom in Neligh on Aug. 21 for a revocation of probation hearing.
Krebs was placed on an 12-month term of probation Sept. 6, 2023, for a conviction of driving under the influence of alcohol.
On Aug. 24, Krebs submitted to a chemical test that was positive for alcohol. He admitted consuming at a tractor pull. According to information from his probation officer, he had been sanctioned for four previous positive alcohol tests and had been placed on continuous alcohol monitor on two occasions for a total of 120 days.
After hearing testimony from one witness called by the defense, Roland Hurtig, and a request for extension of probation by Krebs’ attorney, Martin Klein, Taylor extended probation for six months, including an order to enroll in and successfully complete an intensive outpatient program and follow all aftercare recommendations.
She also suggested he listen to advice from his “good friend,” Hurtig, whose advice is free.
The judge told Krebs he had “irritated” the probation officer who is probably easiest to work with in the whole probation system. She added she did not expect the probation officer to wait for five positive tests to request revocation next time.
“If you come back on a second violation you should expect a jail sentence closer to 30-60 days than 10-20 days,” Taylor said.
