Holt County judge hands down jail sentences

Jayden D. Garett, 23, of Stuart was sentenced to 90 days in the Holt County Jail for a Class 1 misdemeanor assault conviction, with credit given for two days previously served. He was taxed $60 costs. Garett pleaded guilty July 9, pursuant to an agreement with Holt County prosecutor Brent Kelly. Kelly dismissed a driving during suspension charge. Garett was represented by Holt County public defender Rod Smith.

According to an arrest affidavit filed by an O’Neill officer, Garett was arrested May 12 after an incident was reported at the residence of the victim, who also reported Garett had driven onto his property and attempted to run over him. A third party witnessed part of the incident.

Eric E. Babutzke, 32, of O’Neill was fined $500 and committed to the HCJ for 30 days for his conviction of second-offense driving under the influence of alcohol, low test, a Class W. misdemeanor committed March 12 in O’Neill. He was given credit for one day previously served in the county jail, with commitment ordered to commence Sept. 20. The time is a mandatory minimum by statute so no good time is allowed. His driver’s license was revoked for 18 months, with provision for ignition-interlock device. He was also fined $200 for speeding, 53 mph in 25-mph municipal zone.

Babutzke pleaded guilty, pursuant to a plea agreement with Kelly, who reduced the DUI from high test which is a Class 1 misdemeanor. He was represented by Smith.

Nataly Cabrera, 28, was fined $25 and assessed $50 costs for a Class 3 misdemeanor, no valid registration, committed June 14 in Atkinson. She waived her right to counsel and pleaded guilty to the offense as part of a plea bargain. In exchange, Kelly dismissed a Class 2 misdemeanor charge of no proof of financial responsibility.

Luke M. Durgin, 41, of Golden, Colorado, was fined $300 for driving a vehicle without ignition-interlock system and $25 for speeding, 75 mph in 65-mph zone. He was taxed $50 costs. Durgin waived his right to counsel and pleaded guilty. He was cited July 24 on Highway 281 about 20 miles south of O’Neill.

Evan F. Zakrzewski, 62, of O’Neill pleaded guilty, by waiver, to a pair of Class 3 misdemeanors, no valid registration/truck and driving commercial vehicle without CDL. He was fined $200 and $100, respectively, and taxed $49 costs. He was cited June 21 by a Nebraska State Patrol carrier enforcement officer.

Christine G. Bahm, 28, of Chambers pleaded guilty, by waiver, to possession of drug paraphernalia and was fined $100 and $49 costs. She was cited by a NSP officer May 31, on Highway281 about eight miles south of O’Neill.

A 14-year-old O’Neill male pleaded guilty by waiver and was fined $35 and $49 costs for possession of tobacco. He was cited by an O’Neill officer July 4.
