Chambers man sentenced for criminal mischief, trespassing

Karsen L. Peterson, 22, of Chambers appeared in front of the Honorable Kale Burdick last Tuesday, Aug. 13, in the Holt County courtroom in O’Neill for sentencing on crimes committed nearly one year ago - Count I, second-degree criminal trespass, a Class 3 misdemeanor, and Count II, criminal mischief, $1,500-$4,999, a Class1 misdemeanor.

Burdick placed Peterson on probation for 18 months and ordered him to pay $2,672.75 restitution, $1,725.75 to Shane Kaczor and $947 to Loren Butterfield for damages to fences. He was assessed $50 costs of prosecution and will have to pay a total of $570 in probation-related fees.

Terms of probation include 54 days in the county jail (waiverable), on a monthly basis, three days per month, to be served the last weekend of each month an order to obtain a sponsor for AA/NA and to complete recommendations contained within a chemical dependency evaluation, including short-term residential treatment.

Peterson pleaded guilty to the crimes July 9, as part of a plea deal with Holt County attorney Brent Kelly.

A warrant was issued April 23 and served April 29 for Peterson’s arrest, following an investigation into complaints received by the Holt County sheriff’s office regarding an incident that happened in southern Holt and northern Garfield counties after an Aug. 30, 2023, bonfire. Peterson admitted driving through several fences in the area.

He was represented by Holt County public defender Rod Smith.

Angela J. Anderson, 42, of Norfolk faced Burdick for arraignment on Count I, no proof of financial responsibility, a Class 2 misdemeanor, and Count II, no valid registration, a Class 3 misdemeanor.

Anderson waived her right to counsel and pleaded guilty to Count I pursuant to a plea agreement, in exchange for Holt County attorney Brent Kelly’s dismissal of Count II.

Burdick fined Anderson $250 and taxed her $50 for the June 25 offense committed in O’Neill.

Logan A. Poessnecker, 19, of Atkinson faced Burdick on Aug. 6 for a pretrial hearing on Count I, drive during suspension/revocation, a Class 3 misdemeanor; Count II, minor in possession of alcohol (ages 19/20), a Class 3 misdemeanor; and Count III, use of tobacco by minor, a Class 5 misdemeanor. He changed his pleas to guilty on counts I and III. and was fined $100 and $50, respectively, and ordered a six-month term of probation on Count II, including payment of $210 in related fees. He was taxed $50 costs. Poessnecker was represented by Smith.

According to an arrest affidavit filed by an Atkinson police officer, he and a Holt County deputy were parked in the parking lot of an Atkinson convenience store when Poessnecker approached them “stating that we had to move our patrol vehicles and that we could not park there anymore.”

The officers subsequently determined that Poessnecker’s driver’s license had been revoked, with a pickup order in force.

Revel T. Koehler, 31, of Norfolk appeared for arraignment on Count I, no proof of financial responsibility, a Class 2 misdemeanor; Count II, no valid registration, a Class 3 misdemeanor; and Count III, speeding, six to 10 miles per hour above the posted limit.

Koehler waived his right to counsel and pleaded guilty to counts I and III, while Smith dismissed Count II. He was fined $150 and $50, respectively, for the May 19 offenses and taxed $50 costs.
