Holt County judge orders sentence served in Antelope County

Lester E. Brizuela Gomez, 37, of Columbus was sentenced to 45 days in the Antelope County Jail in Neligh for a conviction of criminal attempt of domestic assault in the third degree committed in Holt County. Brizuela Gomez was ordered to appear at the Neligh jail at 5 p.m. July 30 to begin his sentence.

The sentence was ordered July 15 by the Honorable Kale Burdick in the Holt County courtroom in O’Neill after he found Brizuela Gomez guilty of the Class 2 misdemeanor.

Holt County attorney Brent Kelly reduced the charge from third-degree domestic assault, a Class I misdemeanor, and dismissed an identical second charge in exchange for Brizuela Gomez’ no contest plea. He had been arrested Dec. 7, 2023, in O’Neill. He was represented by Holt County public defender Rod Smith. Irma Watt served as interpreter.

Tyler W. Briggs, 20, of Fate, Texas, was sentenced to 10 days in the Holt County Jail as part of his sentence for a driving under the influence of alcohol conviction. He was ordered to appear at the jail July 22. Burdick also fined Brizuela Gomez $500 for the DUI and an additional $25 for not having a valid driver’s license on his person. He was assessed $105 costs and his license was impounded/revoked for one year.

Briggs had also been charged with reckless driving, refusal to submit to chemical test and false reporting, which were all dismissed by Kelly in exchange for his guilty pleas to the remaining charges.

Briggs was arrested March 9 in O’Neill, with a post-arrest breath test result of .214/210 L. He was represented by Michael Sholes of O’Neill.

Patrick C. Murphy, 63, of O’Neill was fined $100 and taxed $50 costs for driving under suspension, a Class 3 misdemeanor committed March 18 in Atkinson. Murphy pleaded guilty pursuant to a plea deal with Kelly, who reduced the charge from driving under revocation. Murphy was represented by Smith.
