Holt County felony cases proceed to district court

The Honorable Kale Burdick, on July 17, bound a Stuart man over to the Holt County District Court on felony charges in three Holt County Court cases. Arraignment is set Aug. 12.

Tyler C. Bain, 43, of Stuart, who was incarcerated in Iowa, did not appear in the Holt County courtroom. Written waivers of his right to preliminary hearings were filed by his court-appointed attorney, Bradley Easland of Norfolk.

Charges include a Class 1D felony, possession of firearm by prohibited person, alleged between July 1, 2023, and March 8, 2024; two Class 3A felony counts of stalking, alleged Nov. 12, 2023; and violation of a protection order alleged Feb. 29. (previous conviction enhances charge to a Class 4 felony).

Bonds of $100,000, 10% cash posted March 9, $100,000, 10% posted March 13, and $50,000, 10%, posted May 2 are continued.

Burdick bound Matthew N. Kilmurry, 36, of Atkinson over to the district court July 16, on two Class 4 felonies, possession of methamphetamine and possession of fentanyl, both alleged May 9 in Atkinson. Arraignment is set Aug. 12, with bond continued at $2,500 personal recognizance.

Jurisdiction for a misdemeanor allegation, possession of legend drugs and two infraction allegations, possession of marijuana and paraphernalia, were waived to the district court.

Kilmurry is represented by Holt County public defender Rod Smith.
