Man arrested at area cemetery bound over on drug charge

Douglas J. Jacobs, 32, of Elgin faced the Honorable Donna Taylor in the Neligh courtroom Wednesday July 3, for preliminary hearing on a Class 4 felony, possession of methamphetamine, alleged May 18 at the Oakdale Cemetery.

Taylor reviewed evidence and heard testimony from Antelope County deputy Trent Howard, after which she found there is probable cause for the case to continue. She bound the case over to the Antelope County district court, where Jacobs is set for arraignment July 31. Bond posted May 28, in the amount of $10,000, 10% cash, is continued.

Jacobs is represented by Antelope County public defender Pat Carney.

Preliminary hearing for a co-defendant, Shayla N. Prochaska, 32, of Brunswick, also on a Class 4 felony meth possession charge, is continued to July 17. She is represented by court-appointed counsel, Ryan Stover of Norfolk.

Denis F. Kerkman, 90, of Tilden faced Taylor, without counsel, to show cause for waiver of a 30-day jail sentence that was part of his April 17 probation sentence. Kerkman’s opportunity for probation included many restrictions, designed by Taylor as incentives to keep him from further violating a protection order granted to his former spouse.

Kerkman testified that he had not violated the protection order since he was placed on probation and presented a letter from his probation officer, who recommended waiver. Taylor waived the jail time. Kerkman’s next 30-day stent is scheduled Oct. 1, with a Sept. 4 show cause hearing.

Cameron J. Schindler, 20, of Neligh appeared on allegations he violated provisions of his probation. A plea bargain was announced. Antelope County Attorney Joe Smith struck a driving under suspension allegation and Schindler admitted using alcohol during probation.

Taylor ordered an update letter from the probation officer and set sentencing July 17.

Schindler was placed on a nine-month term of probation by Taylor on March 6, for a conviction of driving under the influence of alcohol. He had a positive urine test and a preliminary breath test of .109 May 23.

Schindler is represented by Carney.

Daley J. Bearinger, 18, of Clearwater appeared for further arraignment on Count I, second-degree trespassing, a Class 2 misdemeanor committed May 12 at the former Clearwater School property; Count II, careless driving, an infraction; and Count III, violating provisional operator’s permit, also an infraction.

Pursuant to a plea deal, Bearinger pleaded guilty to counts I and III and admitted a probation violation in a separate case. Smith dismissed Count II.

Taylor set sentencing Aug. 7. Bearinger is represented by Carney.
