Man arrested in Ewing faces drug delivery charge

Two defendants recently waived their rights to preliminary hearings on felony charges and were bound over to Holt County District Court by the Honorable Kale Burdick.

Torrey T. Peterson, 30, of O’Neill waived his right to a preliminary hearing when he faced Burdick on May 21.

Burdick bound Peterson over to the district court on three felony counts, Count I, possession of methamphetamine with intent to deliver (140-plus grams), a Class 1B felony; Count II, possession of a controlled substance (meth), a Class 4 felony; and possession of a controlled substance (cocaine), a Class 4 felony. Jurisdiction for two infractions, Count 4, possession of marijuana and Count 5, possession of drug paraphernalia, were waived to the district court as well.

Arraignment in the district court was held June 3 when Peterson entered not guilty pleas. His next court appearance is set Aug. 12. Bond is continued at $300,000, 10% cash.

The crimes were allegedly committed April 12. According to an affidavit filed by Holt County investigator Steven Binkerd, a search warrant was served at Peterson’s camper that was located at an old gas station at the corner of highways 20 and 45B on the east side of Ewing. Members of the Nebraska State Patrol, Antelope County Sheriff’s Office, and Holt County Sheriff’s Office assisted with execution of the search warrant.

According to the affidavit, a backpack found on the seat of a vehicle contained 185.32 grams of a white crystal substance, which later field tested positive as methamphetamine, along with approximately nine grams of an unidentified substance and nine grams of a white powder, which later field tested positive for cocaine. Items of paraphernalia were allegedly located in the camper, as well as marijuana and a loose clonazepam pill. More than $1,000 cash was allegedly found on Peterson’s person.

Peterson is represented by Bergan Schumacher and the firm Bruner Frank from Kearney.

Brianna T. L. Ivey, 21, of Omaha is set for district court arraignment June 17 on two felonies after she filed a written waiver of preliminary hearing June 3. Jurisdiction for misdemeanor and infraction charges were waived to district court as well. Charges include counts I and II, Class 4 felonies, possession of a controlled substance (cocaine and concentrated THC); counts 3-4, Class W misdemeanors, driving under the influence of alcohol and drugs; Count 5, minor in possession of alcohol, a Class 3 misdemeanor; and counts 6-8, infractions, possession of drug paraphernalia, possession of open alcohol container and speeding, 35 mph in 25 mph zone. Personal recognizance bond, in the amount of $5,000, is continued.

Ivey was arrested in O’Neill March 16.

Trey T. Thornburg, 25, of Bassett appeared May 7 on four counts including a Class 4 felony that was dismissed the following day by Holt County attorney Brent Kelly. Kelly said the defendant had a prescription for the medication in his possession March 20 in Basset.

On June 1, Thornburg pleaded guilty, by waiver, to counts 2-4, as charged, possession of marijuana, possession of drug paraphernalia and possession of open alcohol container, all infractions. He was fined $300, $100, $50 and assessed $49 costs.

Burdick issued a warrant for the arrest of Frances D. Janzing, 71, of Atkinson, who failed to appear June 4 for arraignment on two charges, no proof of financial responsibility, a Class 2 misdemeanor, and no valid registration, a Class 3 misdemeanor, both alleged April 24, in Atkinson.
