Judge orders man held without bond pending extradition

An O’Neill man who faces felony charges in three Holt County court cases now awaits extradition to Iowa.

On May 20, the District Court of Fremont County, Iowa, issued a bench warrant for 41-year-old Tyler Bain’s arrest for a violation of his probation. The State of Iowa asked Bain’s return to that state to face the alleged violation.

Bain appeared in front of the Honorable Kale Burdick on the Iowa probation violation charge May 21, when he declined to waive extradition.

However, Burdick found he had signed a waiver June 3, 2022, when his supervision was transferred from Iowa to Nebraska under the Interstate Compact for Adult Offender Supervision.

The Holt County cases include allegations of two counts of stalking on Nov. 23, 2023, possession of a firearm by a prohibited person on July 21, 2023, and violation of a domestic assault protection order on Feb. 29. He had posted bond in all three cases.

Burdick ordered Bain to be held without bond pending his return to Iowa.
