Holt County judge fines defendants

Two individuals were fined by the Honorable Kale Burdick in the Holt Count courtroom in O’Neill last week.

Kaden T. Toth, 19, of Omaha appeared for sentencing on Count I, third-degree assault, a Class 1 misdemeanor, and Count III, criminal mischief, less than $500, a Class 3 misdemeanor, both committed Feb. 11 in O’Neill.

Burdick fined Toth $150 and $50, respectively, and ordered him to pay $60 costs of prosecution.

Counts II and IV, identical charges with a different victim, were dismissed March 19 by Holt County attorney Brent Kelly as part of a plea agreement.

Kristina J. Owens, 27, of Atkinson, was fined $100 for no proof of financial responsibility, a Class 2 misdemeanor; $25 for no valid registration, a Class 3 misdemeanor; and $75 for no operator’s license, also a Class 3 misdemeanor. She was taxed $50 costs for the April 9 offenses committed in Atkinson.

Both defendants were self-represented.

Burdick signed a warrant for the arrest of Matthew P. Delaware, 24, of Omaha. Deleware was ticketed March 16 for fishing without a permit at Carney Park Pond in O’Neill and failed to appear or sign a waiver and pay a $100 fine and $49 costs by May 7 as indicated on his citation. He did provide proof of his purchase of a permit, which is also required for waiver.
