Sentence includes $5,000 restitution, apology, probation

Donovan T. Colfack, 24, of Ainsworth appeared in the Holt County district courtroom in O’Neill on May 13, to be sentenced for four crimes committed in July 2023.

Colfack is ordered to serve four years of probation under the supervision of a state probation officer and was taxed $147 costs of prosecution.

Terms of probation include payment of $1,710 in probation-related fees; payment of $5,000 restitution to Amanda Braun, jointly and severally with a juvenile codefendant; payment of $100 fine on Count III and $300 on Count IV.

He is also ordered to apologize in writing to Braun within 21 days and obtain a chemical dependency evaluation within 14 days. He is ordered to appear in court Sept. 16 to review compliance of terms.

Colfack was represented by Martin Klein of Neligh.

Colfack was convicted March 11, after entering no contest pleas to the four charges included in an amended information, pursuant to a plea bargain, Count I, criminal attempt of burglary, a 3A felony; Count II, possession of a controlled substance, a Class 4 felony; and counts III and IV, possession of drug paraphernalia and marijuana, both infractions. Additionally, Colfack agreed to pay restitution along with his codefendant and Holt County attorney Brent Kelly agreed to make no recommendation at sentencing.

A complaint filed by Kelly in August 2023 charged Colfack with burglary; theft, $5,000 or more; possession of marijuana; possession of oxycodone and the two infractions.

According to an affidavit filed by Holt County deputy Steven Binkerd, he and deputy Mark Liewer investigated a burglary that occurred at Braun’s residence while she was on vacation in July 2023. Among items taken was $5,000 cash from a safe that had been bolted to a shelf in a closet.
