The Board of Trustees of the Village of Clearwater met for a regular meeting Monday, March 11, at 7 p.m., in the fire hall meeting room. Meeting opened at 7 p.m. Notice of Meeting was given in advance by publication in “Summerland Advocate-Messenger,” was posted at US Post Office in Clearwater, Clearwater Market and Cornerstone Bank-Clearwater and was given to board members prior to meeting. Public was informed of location of Open Meeting Act poster.
Present: Kelly Kerkman, Marsha Hart, Cody Kester, Jeff Schlecht, Brian King. Others present: Angie Hupp, Kyle Petersen, Lauren Sheridan-Simonsen, Sheriff Bob Moore, Brian Ferris, Mike Tabbert, Angie Fletcher, Cheyenne Bolling.
Approved minutes of Feb. 12 regular meeting.
Approved minutes of Feb. 26 public hearing.
Approved minutes of Feb. 26 joint meeting.
Approved treasurer’s report. Clerk presented quarterly treasurer's report.
Waived three readings of Ordinance 2024-1.
Approved Ordinance 2024-1 setting the Village Board of Trustees as the Village Board of Adjustment.
Opened board of adjustment hearing at 7:07 p.m. to discuss a variance for setback of a new building at 609 Montana St. Kyle Petersen stated the requirements for variance set by state statute. Discussion held by board, no public statements made.
Closed board of adjustment hearing at 7:13 p.m.
Approved setback variance for 609 Montana St.
Approved motion stating that all findings according to Clearwater zoning regulations were fulfilled.
Approved conditional use permit for use as a daycare at 609 Montana St., for the duration the property is owned by Rustin and Angie Fletcher.
Opened public hearing at 7:16 p.m., to discuss new liquor license application for Two Bills Steakhouse at 211 Iowa St. No public comment was made.

Approved Class C liquor license application for Two Bills Steakhouse at 211 Iowa St.
Approved building permit application from Rustin and Angie Fletcher for new building at 609 Montana St., with setback variance approved earlier in meeting.
Approved building permit application from Mike Tabbert for post and cable fence at 211 Iowa St. on property line as requested by Tabbert. Kerkman asked if Jim Swails, owner of the adjoining property, approved the request as well. Tabbert stated he did.
Approved building permit application from Debb & Jerry LLC for vinyl privacy fence at 510 Main St.
Approved building permit application from Dan & Ronda Schwager to place a garage building at 112 Nevada St.
Approved building permit application from Andy and Amy Ahlers for chain link fence at 610 Montana St.
Approved building permit application from Sons of the Legion for vinyl privacy fence at 509 Main St.
Approved Drawdown #6 of $20,333.75 for $1,650 in local match and $18,350 in DTR grant funds to Five Rule Rural Planning and $333.75 in DTR grant funds to NENEDD.
Approved audit report from Lengemann and Associates for Fiscal Year 2022-2023.
Economic development, maintenance, library, park and clerk reports presented.
Approved transferring $10,000 from economic checking to fire checking to rectify a depositing mistake.
Sheriff’s report presented.
Unfinished business discussed. Board still looking for CORE board member. One correction made on haying contract draft so it will be ready for approval at April meeting.
Discussion held regarding demolition status of 301 Second St. Petersen will send owner a letter.
Discussion held regarding repairs at 608 Colorado St. Plumber dug to water lines from main to curbstop and discovered that lines had already been replaced. After more digging, the problems were on the owner’s property. Village will pay bill for dirt work on public property, but owner will be responsible for the rest.
New business discussed.
Owner of 712 Mitchell’s Ave. requested a one-inch water meter for new sprinkler system at residence. All residences and most businesses in town have three-quarter-inch meters and board has been told the lines going from the main to properties are three-quarter inch. Denied request for one-inch meter.
Confirmed next meeting date of Monday, April 8.
Approved entering executive session at 8:18 p.m. to receive legal advice.
Approved exiting executive session at 8:22 p.m.
Approved claims and payroll. Claims: $50,941.50; wages: $7,814.95.
Meeting adjourned at 8:23 p.m.
