Jose A. Trejo Jr., 19, of O’Neill appeared in the Holt County courtroom in O’Neill on Feb. 13 on two cases.
In the first, he had previously pleaded guilty and was fined $300 for possession of marijuana and $100 for possession of drug paraphernalia, both committed Oct. 29, in O’Neill, as well as $49 costs. He was granted time to pay the fines and costs but had not done so by the Feb. 6 due date. Trejo chose to sit out the fines and costs in the Holt County Jail, at the rate of $150 per day.
In the second case, Trejo was charged with Count I, minor in possession of alcohol, a Class 3 misdemeanor; Count II possession of open alcohol container, an infraction; Count III, possession of drug paraphernalia, an infraction; and Count IV, possession of a controlled substance, THC, a Class 4 felony.
A plea agreement was announced. Holt County attorney Brent Kelly amended Count IV to criminal attempt possession of a controlled substance, a Class 1 misdemeanor, in exchange for Trejo’s guilty pleas. There was a joint recommendation for 10 days jail on counts I and IV and fines on counts II and III. Trejo asked to sit out fines and costs.
The Honorable Kale Burdick sentenced him to two days in the HCJ on Count I and 10 days on Count IV, to be served concurrently. He was taxed $50 costs.
Trejo was cited by an O’Neill officer Nov. 18, 2023.
Shayd S. Rokahr, 19, of Page faced the Burdick for arraignment on two counts alleged Nov. 28, 2023, Count I, no proof of ownership, a Class 5 misdemeanor, and Count II, no proof of financial responsibility, a Class 2 misdemeanor.
Rokahr pleaded guilty to Count II, pursuant to a plea agreement with Kelly. In exchange, Kelly dismissed Count I.
Burdick fined her $300 and assessed $50 costs.
Trejo and Rokahr were represented by Holt Count public defender Rod Smith.
Fred E. Wohlert, 72, of South Sioux City failed to appear Feb. 6 on charges of speeding and driving under suspension, alleged Oct. 10, 2023.
Burdick issued a bench warrant, with bond set at $3,000, 10%.
