Domestic incident leads to fines

A domestic incident last October in O’Neill has cost each of the participants $550, after they faced the Honorable Kale Burdick in the Holt County courtroom in O’Neill last Tuesday, Feb. 6, on criminal charges. Deals with Holt County attorney Brent Kelly diminished the penalties from what they could have been.

Jacob J. Reed, 42, faced Burdick for arraignment on two charges, third-degree domestic assault, a Class 1 misdemeanor, and assault by strangulation/suffocation, a Class 3A felony. Pursuant to the plea agreement with Kelly, Reed pleaded guilty to a single count in an amended complaint, third-degree assault by mutual consent, a Class 2 misdemeanor.

Burdick fined Reed $500 and assessed $50 costs. He was represented by Martin Klein of Neligh.

The other party in the altercation, Jamie L. Olberding, 33, also appeared in front of Burdick. She was arraigned on two Class 3 misdemeanors included in an amended complaint filed by Kelly on Feb. 5, as part of the plea bargain, disturbing the peace and criminal mischief. She pleaded guilty to both counts.

Burdick fined her $250 on each count and taxed her $50 costs.

Charges in Olberding’s original information included third-degree domestic assault, a Class 1 misdemeanor; burglary, a Class 2A felony; possession of a controlled substance, hydrocodone; and criminal mischief, a Class 3 misdemeanor. Olberding was represented by Michael Sholes of O’Neill.

Mathew N. Kilmurry, 36, of Atkinson appeared for arraignment on Count I, no valid registration, a Class 3 misdemeanor; Count II, no proof of financial responsibility, a Class 2 misdemeanor; Count II, DUS, a Class 3 misdemeanor and Count IV, no proof of ownership, a Class 3 misdemeanor. Kilmurry waived his right to counsel and pleaded no contest to all four crimes committed Dec. 13, 2023. Burdick adjudged him guilty and fined him $25, $250, $250 and $50, respectively, and taxed him $50 costs.

Heidi M. Boettcher, 45, of O’Neill faced Burdick for arraignment on a Class 2 misdemeanor count, driving under revocation. Boettcher waived her right to counsel and pleaded guilty to an amended charge of driving under suspension, a Class 3 misdemeanor. Burdick fined her $100 and assessed $50 costs

Judge turns bail

over to county treasurer

The Honorable Tami K. Schendt, presiding via Zoom, ordered $1,350 in bail funds be turned over to the Holt County treasurer, after deduction for payment of costs due in the case. The bail was adjudged forfeited in April 2023 when James S. Parker, 28, of Long Pine failed to appear in court.

He was charged with Count I, driving under the influence of alcohol (.15 grams or more), fourth offense, a Class 2A felony; Count II, open container violation, an infraction; Count III, operating motor vehicle during revocation, subsequent offense, a Class 2 misdemeanor; and Count IV, distracted driving (use of handheld wireless device), an infraction, all alleged Dec. 10, 2022.

Schendt presided over the case due to Burdick being a witness to the alleged offenses.
