Ryan Brummels, 23, of Ewing appeared in front of the Honorable James Kube in the Antelope County district courtroom in Neligh last Friday, Jan. 19, to be sentenced for first-degree sexual assault of a minor, a Class 2 felony committed Dec. 26, 2022.
After reviewing a report provided by the Nebraska probation office and school records submitted by the defendant, Kube found Brummels was not a suitable candidate for probation, indicating a sentence lesser than incarceration would depreciate the seriousness of the offense and promote disrespect for the law. He then sentenced Brummels, who is represented by Frederick Bartell of Norfolk, to not less than four nor more than five years in an institution under the jurisdiction of the Nebraska Department of Corrections.
A Class II felony carries the potential for up to 50 years imprisonment.
Brummels was ordered to pay court costs in the amount of $379.43 and was advised of the requirements of the Nebraska Sex Offender Registration Act, which the Brummels acknowledged. In a plea agreement between Brummels and Antelope County prosecutor Joe Smith last October, both parties agreed to a stipulated 25-year registration obligation.
Brummels was remanded to the custody of Antelope County sheriff Bob Moore for execution of sentence.
Smith filed the charge, along with a motion for an arrest warrant, Feb. 2, 2023, following an investigation by an Antelope County deputy.
