Timothy A. Seger, 59, of Spalding, on Nov. 1, signed a written waiver to his right to preliminary hearing on a Class 4 felony charge, possession of a controlled substance, methamphetamine, alleged April 20.
The Honorable Kale Burdick accepted the waiver Nov. 2 and bound Seger’s case over to the Holt County district court, where he was scheduled for arraignment Nov. 6, on the felony as well as two lesser charges, driving left of center, an infraction, and improper lighting, a Class 3 misdemeanor.
In the district court, Seger filed a waiver of appearance and a written not guilty plea. The Honorable Mark Kozisek accepted the waiver and tentatively set pretrial hearing for March 11, 2024. A $1,500 personal recognizant bond is continued.
Seger is represented by Holt County public defender Rod Smith.
According to an affidavit filed by an O’Neill police officer, Seger had stopped on West Hynes Ave. in O’Neill with the front of his vehicle over the centerline and without headlights on. Although he failed field sobriety tests, Seger blew 0 on a preliminary breath test. With Seger’s permission, the officer moved the vehicle to a nearby parking lot. As he was exiting the vehicle he saw a small clear plastic bag with white crystal-like substance, believed to be meth, in plain view on the driver’s side floorboard. Seger was then placed under arrest. The substance later field tested positive for meth.
