Omaha man waives personal appearance on 'shroom charge

A written waiver was recently approved by the Honorable Kale Burdick, allowing an Omaha man to forgo a personal appearance in the Holt County courtroom for arraignment on three counts, as well as his waiver of a preliminary hearing on a felony.

Mark D. Brower, 32, of Omaha is charged with a Class 4 felony, possession of a controlled substance, (psilocybe cubensis), along with two infractions, possession of drug paraphernalia and possession of less than one ounce of marijuana.

Burdick bound the case over to the Holt County district court, where Brower was set for arraignment Oct. 2. Bond in the amount of $15,000, 10% cash, is continued. Brower is represented by John Farrell of Omaha.

Brower was arrested on the allegations July 27 by a Nebraska State Patrol trooper, following a traffic stop west of O’Neill on Highway 20.

Audrianna K. Johnson, 21, of O’Neill faced Burdick on Count I, nonresident fail to register within 30 days, a Class 3 misdemeanor, and Count II, no proof of financial responsibility, a Class 2 misdemeanor. She waived her right to counsel and pleaded guilty to Count I, pursuant to a plea agreement. Holt County attorney Brent Kelly dismissed Count II. Burdick fined Johnson $25 and taxed $50 costs for the July 29 offense.

Levi W. Hollenback, 42, of Ewing pleaded guilty, by waiver, to possession of an open alcohol container, a Class 3 misdemeanor committed Aug. 14. He was fined $50 and $49 costs.

Mark G. Landgren, 60, of Bartlett pleaded guilty, by waiver, to a Class 5 misdemeanor, drive commercial motor vehicle without CDL. He was fined $100 and $49 costs.

Colton A. Clemens, 26, of Mitchell, South Dakota, pleaded guilty, by waiver, to a Class 4 misdemeanor, no fuel permit, and was fined $100 and $49 costs. He was cited north of O’Neill on Aug. 1, by a NSP carrier enforcement officer.
