Burglary case bound over to Antelope County district court

Christopher W. Robinett, 20, appeared in front of the Honorable Donna Taylor in the Antelope County courtroom in Neligh on Sept 6, set for preliminary hearing on a Class 2A felony burglary charge.

Robinett, accompanied by his court-appointed attorney, Martin Klein of Neligh, waived his right to the preliminary hearing and Taylor bound the case over to the Antelope County district court, where he is set for arraignment Sept. 27. Bond is continued, in the amount of $10,000, 10% cash.

Shane L. Krebs, 52, of Clearwater faced Taylor for sentencing on a count of driving under the influence of alcohol (+.15), a Class W misdemeanor committed June 9.

Klein requested probation for his client, asking Taylor to consider ongoing family issues. He said Krebs was working with his health insurance regarding treatment.

Antelope County Attorney Joe Smith noted Krebs’ alcohol content of .283 and that it was his first offense. He said he had no objection to probation.

Taylor ordered a one-year term of probation, including a $500 fine; payment of $390 in probation fees; 90 days on a continuous alcohol monitor, 30 days immediately and the remaining 60 days at the discretion of the probation officer; outpatient treatment as recommended in an alcohol evaluation; and two days in the county jail, with credit for one day already served. He is ordered to report to the jail at 9 a.m. Sept. 23. He was taxed $150 costs and was given $275 credit on fine for his out-of-pocket payment for the alcohol evaluation.

James A. Swails, 54, of Clearwater waived his right to counsel and pleaded guilty to one count, selling tobacco to a minor, a Class 3 misdemeanor. Taylor fined him $250 and assessed $50 costs for the offense committed Aug. 10 at Neligh Vape Shop. Swails told the judge he had asked for an ID but misread the birth year.

Michael R. Pulis, 46, of Atkinson appeared for sentencing on three counts, Count I, no proof of financial responsibility, a Class 2 misdemeanor; operate an unregistered vehicle, a Class 3 misdemeanor, and careless driving, an infraction, all committed Dec. 21, 2022, when he was involved in a two-vehicle collision west of Neligh.

Antelope County public defender Pat Carney, who was appointed to represent him last month, requested continuance. He said he still had a couple of things to follow up on and to discuss with Smith. Taylor continued sentencing to Oct. 4.

Matthew J. Wright, 48, of Oakdale appeared for a show-cause hearing to request waiver of a 30-day jail sentence. He told the judge that he had requested a letter from his probation officer but had not received it. Taylor said she had not received the document either and would not waive the jail sentence without it. She continued the hearing to Oct. 4 and postponed his date to report to the Antelope County Jail to Oct. 12.

Wright was reminded that he remains on probation and is subject to all terms. The waiverable jail time was ordered by Taylor Nov. 16, 2022, as part of Wright’s 12-month probation sentence for his conviction of two counts of first-degree assault, committed July 2, 2022.
