VILLAGE OF CLEARWATER

AN ORDINANCE OF THE Village of Clearwater, NEBRASKA TO CONFIRM THE SALE OF REAL ESTATE LOCATED AT 507 FIRST STREET FOR $2,000 TO Tony Blecher; TO REPEAL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT; AND TO PROVIDE FOR THE PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM.

BE IT ORDAINED BY THE CHAIRPERSON AND Board of Trustees of the Village of Clearwater, NEBRASKA:

SECTION 1. The Village of Clearwater is the owner of the following described real estate (hereinafter the “Real Estate”):

That part of the Station Grounds of the former Fremont, Elkhorn & Missouri Valley Railroad, now the Chicago and Northwestern Railway Company, in the Northeast Quarter of Section 1, Township 25 North, Range 8 West of the 6th P.M., Antelope County, Nebraska, described as follows:

Commencing at the southeast corner of Lot 20, Station Grounds, in the Town of Clearwater, Antelope County, Nebraska, the point of beginning; thence N 30°04’30” E, 106.57 feet to a point 8.5 feet southwesterly, measured radially, from the centerline of Railway Company sidetrack I.C.C. No. 12; thence S 60°04’34” E , parallel with said centerline of Railway Company sidetrack I.C.C. No. 12,

81.85 feet; thence S 30°04’30” W, 106.75 feet to the northerly right- of-way line of First Street; thence N 60°00’00” W along said northerly right-of-way line of First Street 81.85 feet, to the point of beginning. Said tract includes the West 1.85 feet of Lot 18 and all of Lot 19, Station Grounds in the Village of Clearwater, Antelope County, Nebraska.

SECTION 2. Pursuant to Neb. Rev. Stat. § 17-503.01, a resolution was passed on July 10, 2023, by the Board of Trustees of the Village of Clearwater directing the sale of the Real Estate to Tony Blecher (hereinafter the “Buyer”) for $2,000.00.

SECTION 3. Notice of the aforementioned resolution and the sale of the Real Estate was posted in three prominent places within the Village on July 14, 2023. The notice gave a general description of the property offered for sale and stated the terms and conditions of sale.

SECTION 4. Seven days have passed since the posting of the notice provided in Section 3, and the Village hereby confirms the sale of the Real Estate to the Buyer via ordinance.

SECTION 5. The Chairperson of the Village Board of Trustees is hereby authorized to sell the Real Estate to the Buyer and to execute any and all documents to close said transaction.

SECTION 6. All ordinances or parts of ordinances in conflict be and the same hereby are repealed.

SECTION 7. Three-fourths of the Board of Trustees voted to suspend the requirement that this ordinance be read by title on three different days.

SECTION 8. This ordinance shall be effective from and after its passage, approval and publication as provided by law.

SECTION 9. This ordinance shall be published in pamphlet form and available for public inspection during normal village office business hours.
