Antelope County case continued, pending possible dismissal

Taylor Schwager, 36, of Orchard appeared in front of the Honorable James Kube in the Antelope County district courtroom in Neligh, Aug.30, with his attorney, Ron Temple.

Taylor was charged with violating provisions of his post-release supervision. Temple asked for continuance, telling the judge he expected resolution by dismissal. He said no charges had yet been filed in Lancaster County for an alleged DUI.

Antelope County Attorney Joe Smith did not object.

“I anticipate dismissal,” he said.

Kube continued arraignment to Sept. 27, unless the case is dismissed. He did not order bond but reminded Schwager that he remains under provisions of the post-release supervision order.

Christopher Robinett, 20, of Neligh appeared without counsel on charges he violated probation. Kube appointed Martin Klein of Neligh, who is representing the defendant on several pending charges in Antelope County Court, including a felony burglary charge, leaving the scene of a property-damage accident, driving under the influence and no proof of financial responsibility.

The probation violation also includes his alleged failure to show for chemical testing on several occasions. He is set for further hearing Sept. 27. Kube did not order bond in this case but reminded Robinett that he remains on probation and must comply with all its terms.

Attorneys for several defendants, indicating resolution was close in their clients’ cases, requested continuances of pretrial hearings and, in two cases, jury trials also. They include:

•Morgan Anson, represented by Carney, is accused of several counts, including theft by receiving stolen property valued at more than $5,000, a Class 2A felony, possession of methamphetamine, a Class 4 felony, use of motor vehicle to avoid arrest, theft by receiving stolen property valued at more than $5,000, a Class 2A felony, possession of methamphetamine, a Class 4 felony, use of motor vehicle to avoid arrest, a Class 4 felony, possession of burglar tools, a Class 4 felony and obstruction of a police officer, a Class 1 misdemeanor, all alleged Dec. 9, 2022, pretrial continued to Sept. 27, trail remains on Oct. 10 docket, $50,000, 10% bond continued;

•Matthew Williams, represented by Carney, accused of Count I, use of a deadly weapon (firearm) to commit a felony, a Class 1C felony, Count II, making terroristic threats, a Class 3A felony, Count III, third-degree assault, a Class 1 misdemeanor, all alleged June 21, 2022, in Neligh, pretrial continued to Oct. 25, trial to Dec. 12, $50,000, 10% bond continued;

•Koda Fernau, represented by Ryan Stover, accused of Class 3A felony, making terroristic threats, pretrial continued to Oct. 25, trial Dec. 12, $25,000, 10% bond continued; and

•Rider Short, represented by Fred Bartell, accused of Count I, operating a motor vehicle to avoid arrest, a Class 4 felony bound over from county court, along with Count II that was direct filed in district court, theft by unlawful taking, greater than $5,000, a Class 2A felony. Both crimes are alleged July 4 in downtown Neligh, pretrial continued to Sept. 27, trial remains set for Oct. 10, $ bond continued.
