Holt County defendants sentenced to probation, jail

Jericho D. Neal, 24, of Atkinson faced the Honorable Kale Burdick in the Holt County courtroom in O’Neill on Jan. 10 to be sentenced for several crimes committed last spring - including Count II, a Class 1 misdemeanor, procuring alcohol to a minor; three Class 3 misdemeanors, Count IV, possession/discharge illegal fireworks, Count V, shooting highway signs, Count VI, shooting wildlife from highway; and Count VII, an infraction, possession of less than an ounce of marijuana.

Burdick sentenced Neal to a 12-month term of probation, including $390 in fees. He was ordered to spend two days in jail beginning Jan. 20, and an additional 28 days beginning Dec. 1, if not waived by the court. Drug and alcohol testing may be conducted by sweat patch. In addition, Neal was fined a total $1,450 - $500 on Count II, $50 on Count IV, $100 on Count V, $500 on Count VI and $300 on Count VII. He was taxed $50 costs of prosecution.

Neal, who was represented by Brad Montag of Norfolk, pleaded guilty to the crimes Nov. 1, pursuant to a plea agreement with Holt County attorney Brent Kelly. In exchange, Kelly dismissed four counts - contributing to the delinquency of a minor, criminal mischief, possession of drug paraphernalia and possession of a controlled substance (concentrated THC).

Neal was cited by a Holt County deputy May 31 in the parking lot of an O’Neill business.

Shaley F. Kohl, 29, of O’Neill appeared for sentencing on a Class 2 misdemeanor, criminal mischief, committed Sept. 11, 2022. Burdick sentenced her to 12 months of probation, including a $30 enrollment fee and $60 drug-testing fees and she was taxed $60 court costs. Probation programming fees of $300 were waived. She was ordered to serve 24 days in the Holt County Jail, two days to be served per month, beginning the last Friday of each month. Jail may be waived by the court each month, at the request of the probation officer. Drug and alcohol testing may be conducted by sweat patch. Kohl was ordered to complete 10 hours of community service each week for the duration of the probation term and is required to complete a diagnostic mental health interview and follow all therapeutic recommendations.

Kohl, who waived her right to counsel, pleaded guilty to the crime Nov. 8, 2022, pursuant to a plea bargain with Kelly. In return, a disturbing the peace charge was dropped.

Shelley V. Doiel, 48, of O’Neill appeared to be sentenced for third-degree domestic assault, a Class 1 misdemeanor committed Oct. 1, 2022. Burdick ordered an 18-month term of probation, including 36 days in the HCJ, to be served two days per month, beginning the last Friday of each month. Jail may be waived by the court each month, at the request of the probation officer. She was ordered to pay a $30 probation enrollment fee and $60 court costs. Probation programming fees of $450 were waived. Doiel was ordered to obtain a psychological evaluation and follow all recommendations and perform 10 hours of community service each week for the duration of probation. She was self-represented.

Francisco J. Sotelo, 28, of Raymondville, Texas, pleaded guilty, pursuant to a plea agreement with Kelly, to disturbing the peace and criminal mischief, Class 3 misdemeanors committed Sept. 25, 2022. In return, Kelly dismissed a Class 2 misdemeanor count, criminal attempt of assault.

Burdick fined him $100 on each count, ordered him to pay $380.01 restitution to Carriage House Motel in O’Neill and taxed him $50 costs.

He was represented by Ashley Boettcher of O’Neill.

Jeffrey J. Simpson, 38, of Onawa, Iowa, pleaded guilty by waiver, to driving a commercial vehicle without a CDL. He was fined $100 and taxed $49 costs. Simpson was cited Dec. 5 by a Nebraska State Patrol carrier enforcement officer at the Highway 275 scale.

William J. Hulsing, 53, of Onamia, Minnesota, pleaded guilty by waiver to two counts. He was fined $50 for failing to stop and weigh, a Class 3 misdemeanor, and $100 for failing to have or carry a fuel permit, a Class 4 misdemeanor. He was assessed $49 costs. Hulsing was cited by a NSP carrier enforcement officer Dec. 13, near the scale.

Anthony C. DeWindt, 31 of Chambers pleaded guilty, by waiver, and was fined $100 for a violation of Nebraska deer regulations, failing to check deer during nine-day deer season. He was assessed $49 costs. DeWindt was cited for the Class 2 misdemeanor by a Nebraska Game and Parks officer Nov. 22 near his residence.
