Judge reinstates $100,000 bond for O'Neill man

Tyler C. Bain, 39, of O’Neill appeared in front of the Honorable Kale Burdick in the Holt County courtroom in O’Neill on Tuesday, May 3, for bond hearings in two county court cases. Bain was represented in each case, for purposes of bond review only, by Holt County public defender Rodney Smith. Bain had appeared April 3, when he requested court-appointed counsel. After holding an indigency hearing, Burdick denied the request.

In the first case, Bain, who is charged with third-degree domestic assault, a Class 1 misdemeanor, and terroristic threats, a Class 3A felony, had posted $10,000 - 10% of a $100,000 bond - March 17. Burdick revoked/forfeited the bond April 20, after finding the defendant had violated conditions for no contact with the alleged victim. Although Holt County attorney Brent Kelly had filed a motion to forfeit, Bain asked for bond to be reinstated. Burdick found the bond should be partially forfeited and partially reinstated. He ordered $1,000 forfeited and ordered Bain to pay an additional $1,000 to secure his release from custody, with conditions remaining for no contact with the alleged victim nor her brother.

Bond was also reviewed in a second case, on a charge of violating a protection order. Burdick reduced $20,000, 10% bond to $10,000, 10%, with condition for no contact with the alleged victim nor her children.

Stacy M. Reed, 43, of Atkinson faced Burdick to be sentenced for third-degree domestic assault, a Class 1 misdemeanor. She was sentenced to 15 days in the Holt County Jail, with credit for two days previously served, and was taxed $60 costs. Reed pleaded no contest to the reduced charge March 8, pursuant to a plea agreement with Kelly. Kelly amended the charge from a Class 4 felony, third-degree domestic assault, subsequent offense. Reed was represented by Smith.

Denise M. Buoy, 53, of Burke, South Dakota, was sentenced to a six-month term of probation, including $210 in probation fees, a $500 fine and a 60-day revocation of her driver’s license for her conviction of Count I, driving under the influence of alcohol, first offense, a Class W misdemeanor. She was fined $100 for Count II, failure to yield to emergency personnel, an infraction, and was taxed $105 costs of prosecution. She pleaded guilty to Count I, reduced from DUI +.15, and Count II as charged, pursuant to a plea agreement with Kelly. According to a probable-cause affidavit filed by a Nebraska State Patrol trooper, Bouy did not immediately stop at the direction of a firefighter who was directing traffic Nov. 21, 2021, at a scene in the Atkinson area where cattle, both alive and dead, were on the roadway, and was later found to be under the influence. She was represented by Smith.

Robert C. Campbell, 49, of Norfolk appeared for sentencing on a Class 3 misdemeanor, second-degree criminal trespass. Burdick ordered an 18-month term of probation, including probation fees totaling $330 ($150 waived); a $500 fine and $60 costs. Campbell pleaded guilty to the charge March 11, pursuant to a plea deal. In exchange Kelly dismissed a disturbing the peace charge.

Campbell was represented by Ronald Temple of Norfolk.

Crystal J. Diedrich, 35, of Grand Island, waived her right to counsel, pleaded no contest and was found guilty of a Class 3 misdemeanor, operating a motor vehicle during time of suspension. Burdick fined her $100 and taxed $50 costs. Diedrich was cited April 1 in O’Neill.

Erin Hanlin, 39, of Gregory, South Dakota, was allowed to plead guilty by waiver, to a charge of issuing a bad check to Ewing Family Foods on March 24, 2020. She was fined $250, taxed $50 costs and ordered to pay $207.84 restitution.

Dale A. Nicolaus, 75, of Naper pleaded guilty, by waiver, to using farm plates to haul commercially, a Class 4 misdemeanor. He was fined $100 and assessed $49 costs. Nicolaus was cited near the ethanol plant at Atkinson by a NSP carrier enforcement officer April 22.

Kent P. White, 69, of Wentzville, Missouri, pleaded guilty, by waiver, to violating two hunting regulations. He was fined $100 for shooting a hen turkey, while holding a tom-only permit, a Class 3 misdemeanor, $50 for not having a habitat stamp, a Class 5 misdemeanor; and taxed $49 costs. White was cited by a Nebraska Game and Parks officer April 20, near Stuart.

Bob J. Christiansen, 53, of Norfolk pleaded guilty, by waiver, to driving a commercial motor vehicle without a CDL, a Class 3 misdemeanor. He was fined $100 and assessed $49 costs. Christiansen was cited April 27 by a NSP carrier enforcement officer near the junction of highways 20 and 275.
