Randy J. Aime, 57, of O’Neill was placed on probation for five years for third-degree domestic assault, subsequent offense, a Class 3A felony, committed Oct. 17, 2021. Aime was sentenced Monday, April 11, by the Honorable Mark Kozisec in the Holt County district courtroom in O’Neill. Terms of probation include continuing outpatient services until discharged by the provider, attend at least two Alcoholics Anonymous meetings per week, obtain a sponsor and, due to the recurrent nature of the offense, explore mental health symptoms. He was also ordered to complete programs or classes as determined by probation officer, including a batterer’s intervention program. Aime was taxed $147 costs of prosecution and was ordered to pay probation fees totaling $1,830.
Aime pleaded guilty to the charge Feb. 15, pursuant to a plea agreement with Holt County attorney Brent Kelly. Kelly dismissed a count of second-degree domestic assault.
Aime was arrested Oct. 17, 2021. According to a probable-cause affidavit filed by an O’Neill police investigator, the victim reported Aime had hit her on the head four times and had thrown a drinking glass at her, which broke causing injury.
He was represented by Holt County public defender Rodney Smith.
Joey S. Perot, 41, Holt County Jail, was sentenced to concurrent terms of 12 months and 24 months, respectively in a facility under the jurisdiction of the Nebraska Department of Correctional Services for crimes of third-degree domestic assault, a Class 1 misdemeanor, and strangulation, a Class 3A felony. He was given credit for 124 days previously served in the county jail. Provided none of his good time is lost, Perot must serve 12 months, less 124 days, before attaining mandatory release. Kozisec also ordered an 18-month term of post-release supervision. He was remanded to the custody of the Holt County sheriff to be transported to the Nebraska Penal and Correctional Complex near Lincoln.
Perot pleaded no contest to the two counts Jan. 24, pursuant to a plea deal with Kelly. In exchange, Kelly dismissed a felony count of first-degree false imprisonment and agreed to file no additional charges regarding an alleged assault while he was confined in the county jail.
Perot was arrested Sept. 26, 2021. According to a probable-cause affidavit filed by an O’Neill police officer, the victim reported the defendant had “choked her out.” “I couldn’t breathe at all, I thought I was going to die,” she told the officer.
