Holt County judge hands down fines, jail time

Roger R. Hauf, 20, of O’Neill faced the Honorable Kale Burdick on Tuesday, April 5, in the Holt County courtroom in O’Neill, for sentencing on two counts. Burdick sentenced him to a 12-month term of probation for his conviction of minor in possession of alcohol, a Class 3 misdemeanor, and false reporting, a Class 3 misdemeanor, both committed July 24, 2021. Hauf was also fined $500 on the MIP charge, must pay probation fees totaling $390 and $60 costs of prosecution. He is also ordered to serve 24 days in the Holt County Jail, two days per month for 12 months, beginning at 6 p.m. on the last Friday of the month. The court may waive the jail time each month upon request of the probation officer. He must attend one AA/NA meeting per week and obtain a sponsor for same. Hauf was represented by Holt County public defender Rod Smith.

Hauf pleaded guilty to the two offenses Nov. 2, 2021, pursuant to a plea agreement with Holt County attorney Brent Kelly. In return Kelly dismissed a Class 1 misdemeanor count of obstructing a peace officer.

Brandon A. Campbell, 33, of Inman appeared for sentencing on a count of driving under the influence of drugs, first offense, a Class W misdemeanor. Burdick sentenced him to seven days in the Holt County Jail, with credit for five days previously served, and fined him $500. He was also fined $25 for an infraction, driving left of center. Campbell, who waived his right to counsel, asked to complete community service in lieu of fine and costs. Kelly did not object. Burdick ordered 56 hours of community service by July 5 and Campbell must pay $17 non-waivable costs.

Campbell pleaded guilty to the two counts and Kelly dropped a charge of refusal to submit to chemical test. He was arrested Feb. 8 by an O’Neill police officer.

Burdick fined Gail L. Crosser, 45, of Lincoln $100 for an amended count, driving under suspension/before reinstated, a Class 3 misdemeanor, and $100 for careless driving, an infraction. Crosser was taxed $50 costs. The defendant pleaded guilty to the two counts Feb. 1 and Kelly dismissed a count of false reporting. She was arrested by a Holt County deputy Oct. 24, 2021, in O’Neill. Crosser was represented by Smith.

Alden H. Zuhlke, 65, of Brunswick pleaded guilty to a Class 4 misdemeanor, violate farm registration use, by waiver, and was fined $100 and $49 costs. He was cited by a Nebraska State Patrol carrier enforcement officer northwest of the 20/275 weigh station March 24.

Two defendants failed to appear and face warrants.

Burdick signed a warrant for the arrest of Andrew M. Frowiss, 32, of Omaha, who failed to appear on two Class 1 misdemeanor counts, obstruct a peace officer and attempted escape, alleged Oct. 30, 2021, in O’Neill. Smith requested continuance on behalf of his client. Kelly objected and moved for issuance of a warrant.

Evan Zakrzewski, 59, of O’Neill failed to appear on two felony counts, possession of methamphetamine, with intent to deliver, a Class 2 felony, and possession of a controlled substance, meth, a Class 4 felony. He is also charged with two infractions, possession of paraphernalia and less than one ounce of marijuana, all alleged in October 2020. Kelly filed the complaint March 17 this year. Zakrzewski was released on a $5,000 personal recognizance bond Nov. 3, 2020. Burdick granted Kelly’s request for a continuance to allow time for a warrant.
