Colorado concert goers face Antelope County drug charges

Ian T. McConkey, 30, of Mankato, Minnesota, faced Antelope County judge Donna Taylor Wednesday, Dec. on 15 at the courthouse in Neligh, on Count I, possession of a controlled substance, a Class 4 felony; Count II, inhaling intoxicating substance, a Class3 misdemeanor; and Count III, possession of drug paraphernalia, an infraction. McConkey requested court-appointed counsel. Taylor found him indigent, appointed Antelope County public defender Melissa Figueroa and set preliminary hearing for Jan. 5. Bond posted Nov. 17, in the amount of $20,000, 10%, is continued.

Stephanie E. Marschall, of Mankato, Minnesota, appeared for arraignment two infractions, Count I, possession of marijuana, one ounce or less, and Count II, possession of drug paraphernalia. Marschall waived her right to counsel and pleaded guilty to Count I. Taylor fined her $300 and $50 costs. Count II was dismissed.

According to a probable-cause affidavit, filed by NSP trooper Tyler Mann, McConkey was the passenger in a vehicle driven by Marschall, that he stopped for speeding Nov. 17, east of Brunswick on Highway 20. McConkey allegedly told Mann they were coming from concerts in Colorado. During a search of the vehicle, Mann and NSP trooper Brandon Viterna located 80 empty nitrous oxide (laughing gas) containers and three whippets’ containers (cartridges of nitrous oxide used to charge whipped cream cans), as well as THC edibles, suspected raw marijuana, several pills and, in a wallet found on the passenger seat, “McConkey’s two Minnesota driver’s licenses and a small plastic bag containing a white powder.”

Breanna M. McNutt, 21, of Stanton, appeared for further arraignment on a Class 3A felony count of third-degree assault on a police officer. Pursuant to a plea deal with Antelope County Attorney Joe Abler, the defendant pleaded guilty to charges in an amended complaint, Count I, third-degree assault, a Class 1 misdemeanor, and criminal mischief, a Class 2 misdemeanor. Taylor ordered a presentence investigation and set sentencing Feb. 2. Bond posted Oct. 21, in the amount of $10,000, 10%, is continued.

According to a probable-cause affidavit, filed by Antelope County deputy Shelby Keetle, McNutt was being booked into the Antelope County Jail on Stanton County charges Aug. 12, when she allegedly assaulted Keetle and broke the glass in a window of a jail cell.

Daniel C. Hohrein, 43, of Oakdale appeared for further arraignment on a count of driving under the influence of alcohol, .15 grams or more. Pursuant to a plea agreement, Hohrein entered a guilty plea to a reduced charge, DUI, first offense, committed Oct. 9. Sentencing is set Feb. 2, with $1,500 personal recognizance bond continued.
