Business receives restitution for seven-year-old bad checks

The Honorable Donna Taylor cleared three cases from the Antelope County Court docket when she presided over the Nov. 17 court session in Neligh, including one dating back to 2014.

Joe Wylie, 66, of Cozad, formerly of Ewing, was charged in April 2015 with two felony counts of issuing insufficient-fund or no-account checks (second offense) to Mr. S’s in Oakdale one year earlier. A warrant for Wylie’s arrest, issued in May 2015, was served in Hall County on Nov. 3 of this year. Pursuant to a plea agreement with Antelope County Attorney Joe Abler, Wylie agreed to pay $129.74 restitution to the business and $50 costs of prosecution, in return for Abler dismissing the case. Wylie was self-represented.

Bryan K. Bittner, 42, of Niobrara was fined $250 and assessed $50 costs for a Class 1 misdemeanor count of criminal attempt-fraudulent insurance act. Originally charged with a felony count of violating the fraudulent insurance act, Bittner pleaded no contest to the reduced charge Oct. 6 and was found guilty of the May 2019 offense. He was represented by Brad Montag of Norfolk.

Raymond F. Poli, 44, of Neligh waived his right to counsel and pleaded guilty to a Class 3 misdemeanor count of disturbing the peace, committed Oct. 19 in Neligh. He was fined $200, sentenced to one day in the Antelope County Jail, with credit given for one day previously served, and taxed $50 costs.

Michael D. Fox of Elk Point, South Dakota appeared for an extradition hearing. He was arrested by Antelope County authorities on three outstanding Union County warrants for Class 1 misdemeanor charges. Fox waived formal extradition proceedings and agreed to voluntarily return to South Dakota. He was remanded to the custody of Antleope County sheriff Robert Moore to be delivered to South Dakota authorities.

Jesse J. Tobin, 33 of Kearney appeared to be sentenced for violating probation ordered for a 2017 third-offense DUI conviction. Taylor extended Tobin’s probation for one year, to June 7, 2022. Tobin was represented by Figueroa.

Stacy Kaup, 41, of Bancroft, appeared on an alleged probation violation. Kaup requested continuance to consult an attorney. Taylor granted the request. Arraignment is continued to Nov. 3.

Duane E. Hronik, 50, of Lincoln pleaded guilty, by waiver Nov. 3, to violation of traffic regulations within parks, a Class 5 misdemeanor committed Oct. 1, at Grove Lake. He was fined $25 and assessed $49 costs.

Adam L. Weis, 43, of Petersburg pleaded guilty to five counts, by waiver, Nov. 15. He was fined $100 for driving commercial motor vehicle without obtaining a CDL; $50 for a CMV marking violation; $100 for violating load content requirements; $25 for no brake lights/turn signals; and $50 for a CMV general brake violation. He was assessed $49 costs. He was cited by a Nebraska State Patrol carrier enforcement officer Nov. 2, on the south edge of Neligh.
