Probation revoked, O'Neill man sentenced to jail for 2019 theft

Trey A. German, 21, of O’Neill faced the Honorable Mark Kozisek in the Holt County district courtroom in O’Neill last week to be resentenced for an October 2019 crime. The charge had been reduced from a Class 4 felony to a Class 1 misdemeanor, theft by unlawful taking, $501-$1,499, pursuant to a plea agreement.

Kozisek revoked probation and sentenced German to 300 days in the Holt County Jail, with credit for three days previously served. He ordered payment of the $3,600 restitution balance and accrued probation programming fees of $722, within 180 days of his release from jail.

Provided he loses none of his good time, German is required to serve 155 days.

German was sentenced in February, by Kozisek, to a 24-month term of probation and was ordered to pay $4,000 in restitution to the victim, at a rate of $400 per month.

A motion to revoke probation was filed May 28 by Holt County attorney Brent Kelly after German was charged in Holt County court with issuing a bad check. A plea deal, announced Aug. 2, included German’s admission to three probation violations. In addition to the county court complaint, German admitted arrearage in the restitution payments and failure to complete a victim empathy class and a money management class.

German was represented by Holt County public defender Rod Smith.
