O'Neill man sentenced to Holt County Jail for bad check

Trey A. German, 21, of O’Neill appeared in front of the Honorable Kale Burdick in the Holt County courtroom in O’Neill last Tuesday, Nov. 9, for sentencing on a conviction of writing a bad check, $500-$1,500.

Burdick sentenced German to 30 days in the Holt County Jail and assessed $50 costs of prosecution. He was ordered to stand committed until costs were paid. The jail sentence was ordered to be served consecutive to the sentence in a Holt County district court case. He is projected to be released April 13, 2022, in the district court case, and will have to serve an additional 23 days to fulfil the county court sentence.

German was convicted of the Class 1 misdemeanor Aug. 10, pursuant to a plea deal. A felony count of issuing a bad check, $1,500-$5,000 was reduced by Holt County attorney Brent Kelly in return for German’s guilty plea. Kelly amended the amount of the check, written March 1, on Elkhorn Valley Bank in Norfolk, from $1,600 to $1,460.

German was represented by Holt County public defender Rod Smith.

Randy J. Aime, 57, of O’Neill was bound over to Holt County district court on two counts, third-degree domestic assault and second-degree domestic assault, both Class 3A felonies alleged Oct. 17 at an O’Neill residence. Aime is scheduled for arraignment in district court Nov. 29. Bond, in the amount of $10,000, 10% cash, is continued.

Aime is represented by Smith.

Burdick issued a bench warrant for the arrest of Cynthia M. Pitts, 23, of Versailles, Missouri, who failed to appear in court. Bond is set at $25,000, 10%. Pitts is accused of a Class 3A felony, terroristic threats, and a Class 3 misdemeanor, disturbing the peace, both alleged May 25.

Several O’Neill residents recently pleaded guilty, by waiver, to violations of O’Neill city code. Each defendant was assessed $49 costs in addition to their fines.

Dustin L. Wimmer, 33, was fined $100 for failure to correct nuisance, second offense.

Richard W. Lehmann, 36, was fined $100 for littering. He was cited by an O’Neill police officer Sept. 11 after he dropped a board and failed to pick it up.

Christine E. Coventry, 59, was fined $20 for a Sept. 21 infraction, barking/offensive dog. She was cited after written statements were received reference a dog “barking all day, especially at 4 o’clock.”

Charles R. Miller, 41, was fined $25 for violating city ATV/UTV regulations, a misdemeanor. He was cited Sept. 19 for driving the vehicle without a helmet or flag.

Kathryn A. Miller, 65, was fined $50 for a dog running at large and $20 for a barking/offensive dog. She was cited Sept. 7, after the dog “got into the neighbor’s trash and chased another neighbor’s dog while it was on its own property.”
