Martin R. Siems, 47, of Clearwater was sentenced last week by the Honorable Donna Taylor, in the Antelope County courtroom in Neligh, for reckless driving, a Class 3 misdemeanor committed March 20. Taylor fined Siems $500 and sentenced him to a six-month term of probation, including $220 in probation-related fees and taxed him $50 costs of prosecution.
Siems pleaded guilty to the reduced count Oct. 6, pursuant to a plea agreement. Antelope County Attorney Joe Abler reduced a charge of driving under the influence of alcohol, first offense, and dismissed a second count, refusal of chemical test. He was represented by Ronald Temple of Norfolk.
Anthony P. Lehman, 36, of Carrollton, Texas, faced Taylor for preliminary hearing on Count I, theft by receiving stolen property, more than $5,000, a Class 2A felony, and possession of heroin, a Class IV felony. Taylor found probable cause for trial on both counts, alleged Aug. 20 in Neligh, and bound the case over to the Antelope County district court, with arraignment set Oct. 27. Bond in the amount of $50,000, 10%, is continued. Lehman was remanded to the custody of Antelope County sheriff Robert Moore, pending posting of bond. He is represented by Antelope County public defender Melissa Figueroa.
Brian G. Tibbens, 50, of Elgin waived his right to a preliminary hearing and was bound over to district court by Taylor. He was set for arraignment Oct. 27, on a felony, first-degree assault charge, alleged Sept. 26 at a rural Elgin home. Bond continues at $100,000, 10%. Tibbens was remanded to Moore’s custody. He is represented by Figueroa.
Ronald S. Laible, 77, of Shelby appeared on an overload traffic citation. A plea deal was reached. Laible pleaded guilty to an amended infraction charge, overweight on axle or group of axles. Total weight of 95,420 pounds was reduced by Abler to 91,000 pounds. As part of the agreement, Abler also dismissed a second carrier-enforcement case and waived costs. Laible was fined $25 and $49 costs. He was self-represented.
Starlina M. Moller, 45, of Neligh pleaded guilty, by waiver, to a Neligh city code violation, dog running at large, an August 31 offense. She was fined $25 and assessed $49 costs.
Dustin W. Rosberg, 33, of Petersburg was granted continuance of his pretrial hearing, to Nov. 3, on Count I, DUI, first offense, a Class W misdemeanor, and Count II, possession of an open alcohol container, an infraction, both alleged July 25 on Nebraska Highway 45. Bond posted July 25, in the amount of $1,500, 10%, is continued. Rosberg is represented by Temple.
Tracy L. Bellemare, 50, of Fremont was granted continuance of a pretrial hearing on a second offense DUI charge, alleged July 6. Taylor continued the hearing to Nov. 3. Bond filed July 7, in the amount of $3,000, 10% cash, is continued. Bellemare is represented by Nathan Stratton of Norfolk.
