Probation, $600 restitution ordered in Holt County theft case

Mackenzie G. Sisson, 24, of O’Neill appeared in front of the Honorable Kale Burdick in the Holt County court last Tuesday, May 28, on a Class 1 misdemeanor charge of theft by unlawful taking, $501 to $1,499.

Sisson pleaded guilty, as charged, pursuant to a plea agreement with Holt County attorney Brent Kelly. In return Kelly agreed not to oppose probation. There was joint recommendation for restitution in the amount of $600, payable at a rate of $30 per month. In addition, Sisson’s public defender, Rod Smith, requested waiver of probation fees.

Burdick sentenced Sisson to a 21-month term of probation, with restitution to Sandra Richards ordered, as agreed. Sisson was ordered to pay the $30 probation enrollment fee and $50 costs of prosecution, with $525 in probation fees waived.

Christopher M. Troidl, 32, of Stuart faced Burdick for arraignment on a charge of driving under the influence of alcohol, .08, third offense, a Class W

misdemeanor.

A plea deal was announced by Troidl’s attorney, Martin Klein of Neligh. The defendant agreed to plead guilty to a reduced charge of second-offense DUI, with a joint recommendation for probation.

Burdick sentenced Troidl to an 18-month term of probation, including $570 probation-related fees, a $500 fine, 10 days in the Holt County Jail, revoked his driver’s license for 18 months and assessed him $105 costs of prosecution. Jail sentence was ordered to be served weekends, commencing at 7 p.m. May 21.

Troidl was arrested by a Holt County deputy March 5, in Stuart, after he was observed exceeding a 20 mile per hour posted speed limit within the village.

Jahziel A. Martinez Olguin, also known as Jahziel A. Olguin Martinez and Jahziel A. Olguin, 30, of O’Neill was fined $25 and $50 costs for a count of

no valid registration, a Class 3 misdemeanor committed April 13. Martinez Olguin waived his right to counsel and pleaded guilty to the charge as part of a plea deal with Kelly. In return, two additional counts, no proof of financial responsibility and no operator’s license, were dropped by Kelly.

Jamie L. Olberding, 30, of O’Neill was fined $100 and taxed $50 costs on a count of driving under suspension committed April 6. In return for Olberding’s guilty plea to the charge, Kelly dismissed a second count, no proof of financial responsibility.

Jeffrey R. Wehrman, 34, of O’Neill appeared in front of Burdick for arraignment on an infraction count of possession of marijuana, once ounce or less, first offense. Wehrman waived his right to counsel and pleaded guilty. He was fined $300 and assessed $50 costs.

Ty R. Sierks, 26, of Amelia pleaded guilty, by waiver, to an infraction count, possession of open alcohol container. Sierks was fined $100 and $49 costs forthe April 18 offense.
