Burdick hands down sentences in Holt County court

Pamela K. Barelman, 55, of Chambers faced the Honorable Kale Burdick in the Holt County courtroom Tuesday, May 11, for sentencing on two counts, driving under the influence of alcohol, .08 or more, but less than .15, first offense, and driving on shoulder.

Burdick sentenced Barelman to fines of $500 and $25, respectively, a six-month term of probation, including fees totaling $210; revoked her driver’s license for 60 days and taxed her $105 costs of prosecution. Barelman’s probation terms also included attending two AA meetings per week and an alcohol education class.

Barelman, who was represented by Holt County public defender Rod Smith, pleaded guilty in March to an amended Count I and Count II, as charged, after reaching a plea deal. Holt County prosecutor Brent Kelly reduced Count I from DUI, .15 or more, first offense.

According to a probable-cause affidavit, Barelman was arrested by an O’Neill police officer after her vehicle entered the ditch and became high-centered on a driveway approach on old Highway 108, near the east edge of O’Neill. Her preliminary breath test registered .182, with a post-arrest chemical breath test reading of .171.

Seth K. Brooks, 29, of Page pleaded guilty to three counts committed March 18, Count I, speeding, 16-20 miles per hour above the posted limit, an infraction; Count II, driving under suspension, a Class 3 misdemeanor; and Count III, no proof of financial responsibility, a Class 2 misdemeanor. He was fined $125, $100 and $200, respectively, and was assessed $50 costs.

As part of a plea deal, Kelly reduced Count II, from driving under revocation, subsequent offense, a Class 1 misdemeanor, and recommended fines only. Brooks was arrested by a Nebraska State Patrol officer March 18. He posted bond in the amount of $10,000, 10% cash, the same day.

He was represented by Smith. Raul N. Aguilar, 28, of O’Neill faced Burdick for further arraignment on three counts, Count I, no valid registration, a

Class 3 misdemeanor; Count II, no proof of financial responsibility, a Class 2 misdemeanor; and Count III, no operator’s license, a Class 3 misdemeanor.

A two-week continuance was requested and granted. However, the parties returned to the bench late in the morning, when a plea deal was announced.

Aguilar pleaded guilty to counts II and III, with Count I dismissed by Kelly and a joint agreement for a fine only at sentencing. Burdick fined the defendant $175 on Count II, $75 on Count II and taxed him $50 costs of prosecution.

He was represented by Smith.

Trinity J. Mosel, 20, of O’Neill waived her right to counsel and pleaded guilty to possession of marijuana, one ounce or less, and possession of drug paraphernalia, infractions committed April 9 in O’Neill. Burdick fined her $300 and $100, respectfully, and taxed $49 costs.

Izabel A Kleinberg, 19, of O’Neill pleaded guilty by waiver and was fined $100 and $49 costs for possession of drug paraphernalia. She was cited May 10 by an O’Neill officer.
