Two sentenced in county court

One bound over to district court

Ervin J. Mast, 33, of Ewing was set for a pretrial hearing in the Antelope County courtroom in Neligh last week on four counts alleged Nov. 27, 2020, Count I, driving under the influence, .15 grams or more, first offense, a Class W misdemeanor; Count II, no proof of financial responsibility, a Class 2 misdemeanor; Count III, no valid registration, a Class 3 misdemeanor; and Count IV, possession of an open alcohol container, an infraction.

Antelope County Attorney Joe Abler filed an amended complaint March 17, reducing Count I to careless driving, an infraction, and Count II from the original complaint was dropped.

Mast then pleaded guilty, by waiver, to the three counts on the amended complaint. He was fined $100 for careless driving, $25 for driving a vehicle with no valid registration and $50 for possession of an open container, along with $49 costs.

Mast was represented by Martin Klein of Neligh.

Michael G. Loy, 51, of Elgin faced the Honorable Donna Taylor in the Neligh courtroom. He waived his right to a preliminary hearing and was bound over to Antelope County district court on a count of DUI, third offense (.15 grams or more), a Class 3A felony alleged Feb. 19 in Elgin.

Loy is set to appear in the district court March 31. Bond, in the amount of $25,000. 10% cash, is continued.

At a bond hearing held March 3, Taylor ordered Loy be allowed a $25,000 personal recognizance bond once a bed is available at an inpatient treatment facility.

Loy is represented by Antelope County public defender Melissa Figueroa.

According to a probable-cause affidavit, filed by Antelope County sheriff Robert Moore, a welfare check request was received after a State of Nebraska Road Department truck, driven by Loy, was wrecked. Loy refused a preliminary breath test but submitted to a DataMaster test when he was booked at the law enforcement center, testing .220.

Donneceia D. McFarland, 34, of Oakdale appeared before Taylor for sentencing on a Class 1 misdemeanor, third-degree assault.

Taylor fined McFarland $250 and assessed $50 costs of prosecution.

McFarland was represented by Figueroa.

Starlina M. Moller, 45, of Neligh, who was set for sentencing on a Class 3 misdemeanor, driving under suspension/before reinstated, was given a continuance, until May 19.

Jessica L. Dehn, 26, of Parker, Colorado failed to appear Wednesday for a hearing to show cause for failure to pay $249 due. Taylor ordered, “commitment to issue.”

In January, Dehn was fined a total of $400 and $49 costs for possession of marijuana and possession of drug paraphernalia. She paid $200.
