Bench warrant issued for O'Neill man

The Honorable Kale Burdick signed a bench warrant, ordering the arrest of Trey A. German, 20, after he failed to appear in Holt County court in O’Neill on Tuesday, Jan. 5 for sentencing. Bond is set at $3,000, 10%.

German was charged with I, no operator’s license; and II, operating a motor vehicle during time of suspension, both Class 3 misdemeanors alleged March 3, 2020. After he failed to appear in court June 16 as ordered, a third Class 3 misdemeanor count was added by Holt County attorney Brent Kelly, for failure to appear, and a warrant for his arrest was issued Aug. 17, with bond set at $3,000, 10%. The first warrant was served Oct. 11 and German filed bond. He appeared for arraignment Nov. 3, when he waived his right to counsel and pleaded guilty to all three counts.

Kelly, J. Wells, 37, of O’Neill waived his right to a preliminary hearing when he faced the Burdick on Tuesday.

Burdick bound Wells over to the Holt County district court, where he was set for arraignment Jan. 11 on a Class 2A felony, driving under the influence of alcohol (three prior convictions) The county court waived jurisdiction on an infraction driving left of center count.

Wells is alleged to have been the driver of a yellow bus that was reportedly driving erratically on a county road east of O’Neill on Oct. 28, 2020. A Holt County deputy subsequently observed the bus travelling left of center and conducted a traffic stop. Wells measured .208 on a Datamaster breath test, conducted at the Holt County Jail, after testing .198 on a preliminary test, according to a probable-cause affidavit filed by the arresting officer.

Wells is represented by Holt County public defender Rodney Smith of O’Neill. Bond, in the amount of $20,000, 10% cash, filed Oct. 29, is continued.

Marlon J. Jacinto, 29, of Columbus faced Burdick for arraignment on two counts, no proof of financial responsibility, a Class 2 misdemeanor, and speeding, 16-20 miles per hour above the posted limit (81 mph in 65 mph zone), an infraction.

Jacinto waived his right to counsel and pleaded guilty. He was fined $75 and $125, respectively, along with assessment of $50 costs of prosecution.

Michael D. McDaniel, 29, of O’Neill appeared for arraignment on three counts, I, no proof of financial responsibility, a Class 2 misdemeanor; II, possession of drug paraphernalia, an infraction; and III, possession of marijuana, one ounce or less, first offense, also an infraction.

McDaniel waived his right to counsel and pleaded guilty to counts II and III. Count I was dismissed by Kelly, pursuant to a plea agreement.

Burdick sentenced McDaniel to fines of $100 on Count II and $300 on Count III and taxed him $49 costs of prosecution for the Nov. 28, 2020, offenses.

Tyler T. Alder, 38, of O’Neill pleaded guilty, by waiver, to a pair of infraction counts, I, possession of marijuana and II, possession of drug paraphernalia, committed Oct. 1. He was fined $300 and $100, respectively, and assessed $50 costs.

Jonathon P. Klintworth, 29, of O’Neill pleaded guilty, by waiver, to a count of possession of drug paraphernalia, committed Oct. 19 in O’Neill. He was fined $100 and assessed $49 costs.
