Antelope County district court case resolved in Madison

An Antelope County district court case was adjudicated in the judge’s Chambers at the Madison County Courthouse last week.

Eliud A. Herara-Cuevas, 21, of San Bernardino, California, his court appointed attorney, Pat Carney, and Antelope County prosecutor Joe Abler appeared before the Honorable Mark Johnson, via teleconference, for the pretrial hearing Jan. 5.

A plea agreement was announced, with Count I, theft by receiving stolen property, a Class 4 felony, dismissed by Abler, without prejudice, along with a recommendation for a sentence of time served. In return, Herara-Cuevas’ changed his plea to guilty on Count II, criminal mischief, a Class 3 misdemeanor.

Johnson sentenced Herara-Cuevas to 90 days in the Antelope County Jail, with credit given for 105 days previously served, allowing one day previously served to satisfy costs of prosecution.

Herara-Cuevas was a passenger in a 1994 GMC Suburban that was stopped Sept. 20 in Clearwater by an Antelope County deputy. The vehicle was reported stolen. The defendant was placed under arrest and transported to the ACJ, and upon arrival, admitted to urinating on the back seat of the county cruiser.
