O'Neill man sentenced to jail for domestic assault

Randy J. Aime, 56, of O’Neill appeared before the Honorable Kale Burdick in the Holt County courtroom last Tuesday, Dec. 8, on a charge of third-degree domestic assault. Due to a conviction of the same offense in December 2019, Aime’s charge was a felony.

A plea bargain was reached, with Holt County prosecutor Brent Kelly, striking the previous subsequent offense language, reducing the charge to a Class 1 misdemeanor, in return for Aime’s guilty plea. Kelly further agreed to recommend jail, with credit for time served.

Burdick sentenced Aime to 23 days in the county jail for the Oct. 24 crime, with credit for 19 days served previously, and assessed $50 costs of prosecution. In addition, Burdick sustained a motion to remove a no-contact order from bond conditions, after the victim testified.

Three Kansas men, who were cited for minor in possession of alcohol, ages 19/20 and possession of open alcohol containers Oct. 28, were allowed to depose their cases by waiver, after reaching plea deals with Kelly. Burdick approved the arrangements.

Jacob T. Baker, 20, of Burdett, Kansas, entered a guilty plea to MIP, a Class 3 misdemeanor. Kelly dismissed an infraction, possession of an open alcohol container. Baker was fined $250 and $50 costs.

Lee S. Carlin, 19, of Osborne, Kansas, also pleaded guilty to MIP and was fined $250 and $50 costs. Kelly dismissed an open container charge.

Colton H. Heskett, 20, of Hoxie, Kansas, pleaded guilty to possession of an open container and Kelly dismissed a MIP charge. He was fined $50 and $49 costs.

Cole L. Strong, 19, of Schuyler also pleaded guilty to MIP, by waiver, for an Oct. 28 offense. He was fined $250 and $50 costs.

Austin C. Kempf, 21, of Carroll was allowed to plead guilty by waiver, after his court-appointed attorney, Alissa Baier of Laurel, and Kelly negotiated a plea deal. In exchange for his guilty plea to a Class 1 misdemeanor count of procuring alcohol to minor/incompetent on Oct. 28, another Class 1 misdemeanor, contributing to delinquency of a minor, was dismissed. An infraction open container charge was also dropped by Kelly. Kempf was fined $500 and $50 costs.

Adam J. Wolfe, 40, of Norfolk pleaded guilty, by waiver, to hunting without permission, a Class 3 misdemeanor committed Nov. 14, southwest of Ewing, near 848 Road and 505 Avenue. He was fined $200, along with $500 liquidated damages and $49 costs.

Two men who drive trucks for Admiral Merchants Motor Freight, Inc. of Minneapolis, Minnesota, pleaded guilty, by waiver, and paid fines for violating a 15-minute interval between loads, a condition of their permits to haul their loads in O’Neill.

Joseph C. Gotay, 43, of Cumming, Georgia, and Cecil I. Mason Jr., 49, of Brookline Station, Missouri, were each fined $25 and $49 costs.

Hope M. Petite, 27, of Orchard waived her right to a preliminary hearing and was bound over to Holt County district court, on a Class 4 felony count alleged Sept. 27, possession of a controlled substance, methamphetamine. In addition, Petite was charged with four infraction counts, possession of open alcohol container, possession of marijuana, less than one ounce, and three counts of possession drug paraphernalia. She is set for arraignment in the district court Dec. 28.

Petite failed to appear in court Nov. 3. At the request of Kelly, a citation in lieu of arrest was issued Nov. 3 and was served Nov. 17 by Antelope County sheriff Bob Moore.
