Joel Schrader, 49, of Martell appeared before the Honorable Mark Kozisek in the Holt County district courtroom in O’Neill for sentencing Nov. 23, for crime committed in 2018.
Kozisek sentenced Schrader to 24 months incarceration under the jurisdiction of the Nebraska Department of Corrections, to be served consecutive to a sentence imposed in Lancaster County district court. Assuming Schrader loses none of his good time, he must serve 12 months before his mandatory release. In addition, Kozisek ordered 12-months post-release supervision, including related probation fees totaling $330, and fined Schrader $2,500.
Originally charged with burglary, a Class 2A felony, Schrader pleaded guilty Jan 27, to an amended charge, attempted burglary, a Class 3A felony, pursuant to a plea agreement with Holt County attorney Brent Kelly. As part of the plea deal, Schrader agreed to return personal property taken in the burglary.
Sentencing was originally set for March, but a continuance was granted, due to COVID-19 precautions, to October. Another continuance was granted due to health issues in October. Schrader appeared via Zoom last week.
Schrader, who was represented by Justin Kalemkiarian of Lincoln, was one of three individuals arrested in a burglary at a shop owned by Neil Lange in Atkinson on Sept. 29, 2018.
Codefendants included, James Baily, 44, of Dodge, who was convicted of burglary and sentenced in June 2019, to 60- to 84-months imprisonment under the jurisdiction of the Nebraska Department of Corrections; and Andrew Yonkey, 49, of Bennett, who was convicted of being an accessory to the crime, a Class 4 felony, and was sentenced in October 2019, to 120 days in the Holt County Jail.
