The Legislature concluded the special session that was called to relieve property taxes on Aug. 20. After a contentious start, senators agreed to compromise on legislation that will frontload the Nebraska Property Tax Incentive Act credits from LB1107 (2020) directly onto taxpayer’s property tax statements, trim and adjust the state budget by $185 million and tighten existing property tax levy caps for counties, cities and villages to the greater of inflation or 0%. Of the 81 bills and 24 r...
This week, the Legislature took up the issues of property taxes and adjustments to the state budget. Much of the focus remained on the package crafted by the Revenue Committee and attached to LB34 by Senator Brewer in place of LB1 and LB9. In a long day of constant changes, LB34 was originally intended to resemble LB1 and LB9. During debate, several concerns were raised, including counties and municipalities who opposed the proposed caps, schools that were hesitant that the Legislature could...
As expected, the governor called the Legislature into special session on Wednesday, July 24 to enact legislation relating to property tax relief and school funding. The Legislature convened on Thursday, July 25. Deviating from the preannounced schedule, Speaker Arch chose to not bring the Legislature back into session on Saturday to allow the Revisor of Statutes’ Office more time to prepare new drafts of bills and constitutional amendments. The governor’s package is composed of three bills: LB1...
This week saw the Legislature continue the discussion of the governor’s school finance and tax package. LB 243, as amended by the Revenue Committee, would make a series of changes aimed at easing the financial impact of increasing property tax valuations on Nebraska’s local property taxpayers. Among changes proposed, the measure would increase the minimum amount of relief granted under the Property Tax Credit Act to $388 million in tax year 2024 and $560 million by tax year 2029. This amo...

This past week, the Legislature gave first-round approval to two bills offering tax relief for Nebraskans. Further debate on the two proposals will wait until we are further along in the session and have a better idea of projected revenues and expenses. LB825 accelerates the phase-out of the taxation of social security benefits. Under the proposal, all social security benefits will no longer be subject to the income tax, beginning in 2025. LB723 guarantees a higher level of property tax relief...
Last week, we began debate on the budget, after receiving a briefing from the Appropriations Committee chairman, Senator Stinner. The budget for the next year calls for an increase in the general fund expenditures of roughly $9.7 billion, growing by around 1.7% per year from previous budgets. Key provisions of the budget include substantial increases to several funds. The most important of these increases are the two funds relating to property tax relief. The proposed budget increases the Proper...
The Appropriations Committee advanced their finalized recommendations for the Fiscal Year 2021-22 and 2022-23 biennial budget to the full Legislature. First-round debate took place this past week and all bills were advanced unanimously except LB383, dealing with capital construction. Under the $9.7 billion biennial budget proposal, the two-year average estimated revenue growth is 3.0%, whereas the two-year average growth in spending is just 1.6%.
